Privacy policy

§ 1 General provisions

1. This document sets out the rules for processing and protecting the personal data of Customers using the online Shop available at www.gucio24.com. The document also sets out the rules for the use of “Cookies”.
2. The controller of the personal data of Customers of the online Shop within the meaning of the Act of 29 August 1997 on the protection of personal data is Sławomir Piwowarczyk, os. Oświecenia 22/25, 31-636 Kraków, Tax ID (NIP): 678-262-88-49, REGON: 356287951, e-mail: gucio@buciki.pl.
3. The Controller declares that it observes the rules for protecting the personal data of persons using the website, as well as all legal regulations provided for by the Act of 29 August 1997 on the protection of personal data (consolidated text: Journal of Laws of 2015, item 2135).
4. The data sets of persons using the website have been notified to the Inspector General for the Protection of Personal Data. The data contained in the notification is always up to date and is updated immediately in each case, no later than within 30 days of the date on which the personal data protection measures change. The data sets include a comprehensive description of the protection measures applied by the Controller.
5. The Customer has the right to contact the Controller in order to obtain comprehensive information on how their personal data is used. We always seek to state clearly what data we collect, how we use it, what purposes it is to serve and to whom we pass it on, what protection we provide for that data when it is passed on to other entities, and we provide information about the institutions to be contacted in case of doubt.
6. The Controller applies all the technical measures indicated in the notification to the Inspector General, such as: measures for the physical protection of personal data, hardware measures within the IT and telecommunications infrastructure, protective measures within software tools and databases, and organisational measures ensuring due protection of the personal data processed — in particular protecting personal data against being made available to unauthorised third parties, against being obtained by an unauthorised person and used for an unknown purpose, and against accidental or deliberate alteration, loss, damage or destruction of such data.
7. The Seller of the online Shop, on the terms set out in the Terms and Conditions and in this document, has exclusive access to the data. Access to the Customer’s personal data may also be entrusted to other entities through which the Customer makes payment for purchases in the online Shop, which collect, process and store personal data in accordance with their own terms and conditions, and to entities whose task is to deliver the Goods to the Customer. Access to the Customer’s personal data is granted to the above entities only to the extent necessary and only to the extent that enables them to provide their services, so that the Customer may purchase and receive the Goods and pay for them.

§ 2 Privacy principles

1. The Seller takes all steps necessary to preserve the privacy and confidentiality of the personal data of Customers of the online Shop, and uses personal data only to the extent necessary to fulfil the purpose for which the user entrusted the data to the Controller.
2. The Customer has the right to obtain clear and complete information on how we use their personal data and for what purposes it is needed. We always state clearly what data we collect, how and to whom we pass it on, and we provide information about the entities to be contacted in case of doubts, questions or comments.
3. Should there be any doubt as to the Seller’s use of the Customer’s personal data, the Seller shall promptly take steps to clarify and dispel such doubts, and we answer all related questions fully and comprehensively.
4. The Controller makes every effort to protect Customers of the online Shop against unauthorised access, unauthorised modification, disclosure and destruction of the information in our possession.
5. The Controller will comply with all applicable data protection laws and regulations and will cooperate with data protection authorities and with law enforcement authorities entitled to act. In the absence of provisions on the protection of personal data, we will act in accordance with generally accepted data protection principles, the principles of community life and established custom.

§ 3 Scope and purpose of collecting personal data

13. The Seller declares that providing the data by the Customer, within the scope indicated above, is entirely voluntary and at the same time necessary for the Seller to fully provide the services rendered through the online Shop.

§ 4 “Cookies” policy

1. The Seller automatically collects the information contained in Cookies in order to gather data related to the Customer’s or user’s use of the website. A Cookie is a small piece of text that a website sends to the Customer’s browser and which the browser sends back on subsequent visits to the site. They are used mainly to maintain a session, e.g. by generating and returning a temporary identifier after logging in. The Controller uses “session” Cookies, stored on the Customer’s end device until they log out, close the website or close the browser, and “persistent” Cookies, stored on the Customer’s end device for the period specified in the Cookie parameters or until the Customer deletes them.
2. Cookies adapt and optimise the online Shop and its offer to the needs of Customers through such activities as producing statistics of page views of the online Shop and ensuring the security of the online Shop. Cookies are also necessary to maintain the Customer’s session after they leave the website; it is Cookies that allow them to return to the contents of the basket without losing its parameters, which would otherwise mean having to select the Goods again.
3. The Customer may at any time, using their web browser, completely block and delete the collection of Cookies.
4. Blocking the collection of Cookies on their device may make it difficult or impossible to use some functions of the online Shop, which the Customer is fully entitled to do, but in such a situation must be aware of the limits on the functionality available on the website of the online Shop.
5. A Customer who does not want “Cookies” to be used for the purpose described above may delete them manually at any time. For detailed instructions, please visit the website of the manufacturer of the browser the Customer is currently using.
6. More information about Cookies is available in the help menu of every web browser. Examples of web browsers supporting the said “Cookies” are: Internet Explorer, Mozilla FireFox, Google Chrome, Opera.

§ 5 Rights and obligations

1. The Controller has the right, and also the statutory obligation, to pass on selected or all information concerning Customers of the online Shop to public authorities or third parties who submit such a request for information on the basis of the applicable provisions of Polish law.
2. The Customer has, at any time, the right of access to their personal data collected by the Controller. That right, which covers the possibility of verifying, modifying and supplementing the Customer’s personal data, as well as deleting it and having its processing discontinued, is available without giving any reason.
3. In order to exercise their rights, the Customer may at any time send an appropriate declaration of will to the registered address of the data Controller or by e-mail.
4. Deleting personal data, or the Controller discontinuing its processing, may result in a complete inability to provide the services rendered through the online Shop, or in their serious limitation.
5. The Controller undertakes to act in accordance with the applicable provisions of law and generally accepted principles of community life.
